Non-Interference Principle in Internal States Affairs: An Analytical Study of International Intervention in Iraq by Ali Abdulkarem A Alasheg Publication: , This present study investigates the issues related to the violation of non-interference principle through the pretext of international intervention in the state of Iraq. The main objectives of such intervention in Iraq are not only to prevent Iraq from acquiring weapons of mass destruction or to fight against terrorism, but also enlisted hidden agenda of strategic and economic goals. This study revealed the violation by uncovering various legal and political situations in Iraq and relates them to the importance of non-interference principles designated by the United Nations. In doing so, this research has identified the actual use of legal force at international levels through declassified and classified documents used to support the Iraqi invasion. This research uncovered the United States' (US) interpretations for her Iraqi intervention and how the prosecution is done according to underlying interest and goals which accommodate with the Security Council Resolutions. The current situation in Iraq, however, is sign of serious violation of the United Nations principles. The scope of the study is limited between 2003 until 2011. The methodology used is historical analytical method. Various official documents, news articles and notes from official sources have been analyzed to trace the development in international relations pertinent to the Iraqi affairs. The analysis employs inductive and legal approach where laws and international agreements were used. The study conclude that the non-interference principle is still viable for small countries but proves to be an obstacle to ambitious major states. This study substantiates that the motives and reasons claimed by the United States to invade Iraq have no legal basis according to international laws but the real objectives were oil and strategic occupation in Iraq. The United States' aggression against Iraq is without justification. The non-issuance of a Security Council resolution condemning such aggression is a dangerous international precedent. It led to the unlawful occupation of Iraq, devastated the state, looted Iraqi natural resources, killed and displaced the population, which eventually caused Iraq instability and insecurity. In the end due to disease and epidemics outbreaks as well as environmental pollution, the state of Iraq is facing a serious collapse of its physical and social structure. Eco-Tourism in the Emirate of Abu Dhabi: Analytical Study by Ali Gh Saeid Ali Publication: , The study of eco-tourism in the Emirate of Abu Dhabi was undertaken as it is one of the most important types of tourism offered by the environment of the United Arab Emirates. The region is distinctive by the multiplicity of data of its natural environment, making it one of the leading sites on the world map of eco-tourism; and a favorite destination for the growing number of environment tourists who can enjoy the beaches, desert and nature reserves. Also there is possibility to visit many archaeological sites, forts and other eco-tourism activities that have a great impact on supporting eco-tourism in the future. This importance stems from the objectives of the study which is focused on identifying the most important components of natural and human activities for eco-tourism in the region. As well to acknowledge the factors and circumstances that affect the growth and development of eco-tourism in Abu Dhabi. In addition to highlight the role of the Tourism Authority to determine their responsibilities and duties towards eco-tourism. Also we propose in this study the recommendations for future plans to use in the development of eco-tourism as it is an important area to attract tourists from all over the world. This study is based on the descriptive and analytical approach to study and analyze data on the phenomena studied in order to achieve realistic results through the use of some statistical techniques like Chi-square in data analysis, processing and for cartographic representation. One of the main results of this study is that the Emirate of Abu Dhabi has the natural elements for the eco-tourism; also it has many of the rich archaeological sites, historical, religious, cultural heritage, folk festivals, events and handicrafts. Also most tourists would like to revisit to the region in the future; and this is due to the developments in the Emirate of Abu Dhabi, especially in the establishment of future projects with international standards which contribute to the success of eco-tourism in the region. We must mention that we have noted from the study that there are different points of view of tourists on the defining the term eco-tourism and what it means. The study also found taht the Government of Abu Dhabi dependent on foreign labor in the eco-tourism sites and this may adversely affect the future of tourism in the region. The Administrative System in Islamic Organizations: A Study on the World Islamic Call Society by Ali Saleh Ahmad Mohammed Publication: , The Islamic administrative system which conveys celestial message always takes wahyu (the revelations from Allah SWT) as its main form of reference. The Islamic system combines the element of knowledge, iman and skills in performing tasks while at the same time complete those works with commendable moral virtues. This study explores on Islamic administration system and The World Islamic Call Society is chosen as the sample case. There are numerous Islamic organizations and establishments which provide helps and services to Islam and its people as government agency or non-government organizations (NGO). Their work is based on the goals decided by the establishments. Among the objectives of this study is to identify the administration system used in The World Islamic Call Society. The study also identifies the elements used in the system from the perspectives of work and information technology. This study employs qualitative methodology and analyses to extract meanings and messages embedded in the information and data retrieved. The method is used to show the link between various variables and to give plausible explanations while at the same time, make future assumptions via the elements and information reviewed. The collection of data and information is done through structured survey which correlates with the study theoretical framework and hypotheses. This study found that the administration and policy system used in the World Islamic Call Society was democratically performed. Vis--̀‰vis, it also revealed the motivations were given by the management to its employee to improve work performance. The society has also used adequate work order that guarantees effective and efficient management. This study revealed that the true spirit in the teamwork among the employees at various levels was actually stemmed from the understandings of pure Islamic brotherhood relationship. Consequently, (this study also found that) lack of women's role as policy and decision makers has unfortunately, shortchanged the efficacy of the organization's connection with the targeted mass society. Therefore, this study suggests that workers should be given the opportunity to be involved in policy and decision-making. Such open approach will influence the efficiency of the work structure. Improved work quality based on information technology and work assessment need to be more dynamic to be implemented in such international organizations thus, it can link well with recent changes in administrative disciplines. The Evaluation of Internal Audit in Islamic and Commercial Banks: A Case Study the Faisal Islamic Bank of Egypt and the Sahara Bank of Libya by Ali Idiab Mohamed Idiab Publication: , This study is related to the evaluation of internal audit of the Islamic and commercial banks by carrying case study the Faisal Islamic Bank of Egypt and its branches in the city of Cairo, and the Libya Sahara Bank and some of its branches in the city of Tripoli and Sabha. Generally, Islamic and conventional banks require banking monitoring procedures in order to prevent fraud, abuse, manipulation, negligence and errors in any of their business transactions. The Problem of the study focused evaluation of internal audit of the Islamic and commercial banks, on the other hand there are a lot of commercial banks in the world has been Bankruptcy, and some of them subjected to semi-bankruptcy in the world, Sahara Libyan Bank was one of them has no accurate, objective and fair internal audit in his bank, and absence of evaluation for this audit. Therefore, the objective of this study is to evaluate of the internal auditors of both these banks which in turn reflects their overall performance. This is important in order to ensure that the implementation of banking procedures is in line with the banking principles. This is also to recognize the role of internal auditors in order to prevent frauds, to protect the interests of the employees and to restore public confidence in the bank. The study also aims to identify the audit categories, objectives, terms of reference and ways to overcome risks and problems. This evaluation is also capable to increase the effectiveness and reliability of its products. The study uses descriptive and analysis methodologies by depths of the audit practice of both the Faisal Islamic Bank of Egypt and Libya's Sahara Bank and their respective branches. The result of this study indicate that the Faisal Islamic Bank relies heavily on internal auditors and performs its audit procedures with great detail and objectivity. In its implementation, the Faisal Islamic Bank follow local, international and Sharia guidelines. At the same time, the Faisal Islamic Bank employs officials with high academic qualification such as those possessing master and doctorate degrees in their respective field of expertise. This helps them to maintain and implement the principles of the Bank in categorizing its programs, reviewing, evaluating and verifying the implementation of all its procedures. The study also finds that they have a high level of responsibility in determining vulnerability, abuse, restructuring proposals and to overcome difficulties. On the other side, the study finds that Libya Sahara Bank's internal audit is not carried out in an effective manner and its not in line with current banking developments, either in methodology or monitoring procedures during the auditing process. The study also finds that there was no effort on the part of the Libyan Sahara Bank to establish fixed guidelines when conducting the evaluation. International Protection of the Human Rights: Somalia and Sudan (Darfur) as a Model by Ali Omar Moftah Medon Publication: , The study surveyed the international protection of human rights since the problem of the research signified the debatable relationship between the organized laws of human rights, and the debatable relationship between the universality of human rights and their privacy as well as the exposure of human rights in Somalia and Darfur for many of the violations. One of the main objectives of the study: the clarification the relationship between the international laws which are relevant to the protection of the human rights, clarification the similarities and differences and the commonalities and complementarities between them, the clarification of the concept of human rights between the cultural universality and privacy. Besides, the clarification of the Security Council viewpoint on the human crisis in Somalia and Sudan (Darfur), as well as the knowledge of the success or failure of the human intervention. The approach used in the research are: the historical approach where there will be a discussion of some of the events and developments that are related to the title of the study in preparation to explain the subject of the study. The comparative approach for a comparison between the human international law and the international human rights law as they are considered responsible for human rights protection. Moreover, the applied approach has also been adopted in the study of the international human intervention in Somalia, Sudan (Darfur). The most important results that have been reached at: it is not problematic in the relationship between the organized laws of human rights; both of them are the complement of each other and both the international human rights law, human international law and the international protection of human rights in peace and war. Media Alternatif dan Wacana Kontra-Hegemoni di Malaysia: Satu Kajian Kes Terhadap Harakah, Suara PRM dan The Rocket by Nasrullah Ali-Fauzi Publication: , Tesis ini adalah dalam bidang kajian media di Malaysia. Kajian-kajian yang ada sebelum ini lebih bertumpukan kepada kajian media arus perdana, dan tidak banyak kajian mendalam mengenai media alternatif. Dalam budaya politik Malaysia, wacana publik sebahagian besarnya turut ditentukan oleh laporan media arus perdana yang cenderung mengikut agenda kuasa hegemonik. Justeru kajian ini mencuba menelusuri wacana kontra-hegemoni yang terdapat dalam media alternatif. Kajian ini meneliti wacana kontra-hegemoni dalam kandungan Harakah, Suara PRM dan The Rocket yang dikeluarkan sepanjang bulan Julai 1998 sehingga Disember 1999, iaitu tempoh kebangkitan gerakan "reformasi" di Malaysia. Persoalan yang dikaji ialah: Wujudkah wacan kontra-hegemoni tersebut? Bagaimanakah bentuk-bentuknya? Adakah persamaan dan perbezaan bentuk wacana antara ketiga-tiga media tersebut? Skop kajian difokuskan kepada keberadaan media alternatif sebagai alat penyebaran informasi tandingan ke atas liputan media arus perdana. Kaedah yang digunakan adalah kaedah analisis kandungan kuantitatif dan kualitatif. Pendekatan teoritikalnya berpandukan kepada teori hegemoni yang diasaskan oleh Antonio Gramsci. Kajian ini mendapati bahawa wacana kontra-hegemoni memang wujud dalam kandungan ketiga-tiga media tersebut. Ianya wujud dalam tiga bentuk. Pertama, perjuangan menuntut reformasi dan pendemokrasian. Kedua, kritikan terhadap kerjaan dan parti-parti politik yang berkuasa, mahkamah, polis dan media arus perdana. Ketiga, penjelasan mengenai aktiviti parti-parti pembangkang. Walau bagaimanapun, terdapat perbezaan dan persamaan dalam pemilihan bentuk wacana antara ketiga-tiganya. Harakah lebih memfokuskan kepada kritikan terhadap kerajaan dan parti-parti politik yang berkuasa, mahkamah, polis dan media arus perdana. Sementara Suara PRM dan The Rocket lebih menumpukan mesejnya kepada persoalan reformasi dan tuntutan pendemokrasian. Pelbagai perbezaan politik jangka pendek antara masing-masing parti pembangkang kurang ditonjolkan dalam kandungan ketiga-tiga media tersebut. Hanya persefahaman politik sahaja yang disebarluaskan di dalamnya. Secara keseluruhan, kajian ini mengetengahkan penemuan bahawa bersamaan dengan kuatnya arus penyebaran wacana hegemonik oleh media arus perdana dalam budaya politik Malaysia, wacana kontra-hegemoni pula disebarluaskan secara berterusan oleh media alternatif. Dalam keadaan kurangnya kajian mengenai media alternatif di Malaysia, penemuan kajian ini menjadi salah satu sumbangan berharga bagi korpus kajian akademik dalam bidang media. The Use of Force and International Responsibility in International Law and Malaysian Law: A Comparative Applied Study by Ali Omar Moftah Medon Publication: , The importance of this study lies in the nature of the topic it is dealing with. The use of force within a country poses negative effects on its national unity. Consequently, the use of force at the international level to resolve conflicts may lead to negative effects on international peace and security. The focus of this research is on the existence of countries that resort to force on others under the pretext of legitimate right to self-defense in order to resolve conflicts, to occupy the land of other countries and to evade accountabilities either on the government on individual level for the possible harms inflicted on others. The objectives of this study are to highlight the nature of accountability on the part of government and individuals on the harms and crimes done, in the perspective of civil and criminal laws and to identify the viewpoints of international and Malaysian law regarding the use of force. The methodologies used in this research are inductive approach to gather the views of experts, historical approach to relate historical events pertaining to the research topic and, analysis and comparative approaches for comparing the Malaysian and the international laws in dealing with the subject matter. This study finds that previous societies regardless of their advanced civilization resorted to the use strength and force even for trivial matters. This study finds that even though there were agreements and efforts being made to implement rules and regulations at time of wars, violations of these agreements occurred and still prevail until the present day. In addition, this research finds that most of the countries studied violated war regulations and international conventions which resulted in the loss of civilian lives especially children, women and elderly persons. This study concludes that the legitimacy of using force in carrying out the right of self defense must be subjected to prescribed conditions and, since each individual is considered an international citizen, he therefore bears full responsibility for his actions in the eyes of international laws. This study also concludes that there are still obstacles in present situations for government to arrest war criminals and to bring them to justice.
